Reactivation Employment Permits allow non-EEA nationals who lost their employment permit or fell through the cracks of immigration through no fault of their own to regularise their immigration status in the State. There are 2 stages to this permit type.
Reactivation Employment Permit
Reactivation Employment Permits are relatively uncommon but serve a vital function for individuals who need them. If a person has their employment permit cancelled or becomes undocumented for reasons beyond their control, this mechanism is the route back to regular status.

Eligibility Criteria
- Entered the State on a valid and lawful basis
- Can demonstrate exploitation/mistreatment
- Is of good character and has not violated Irish law
Eligibility Criteria
- Registered with the Revenue Commissioners of Ireland/Companies Registration Office
- Maintains a 50/50 EEA – non-EEA staff ratio
- Commits to pay the employee in accordance with Minimum Annual Remuneration as applicable
Process
A unique application must be submitted to the Department of Justice, Home Affairs and Migration explaining your full situation. If successful, a Temporary Permission to Remain will be granted, enabling a Reactivation Employment Permit application.

Temporary Permission to Remain is decided directly by the Department of Justice, Home Affairs and Migration and is subject to Ministerial Discretion.
